Terms and conditions for using SmartFuelPay services

Acceptance of Terms

Section 1

By accessing and using SmartFuelPay ("Platform", "Service", "we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use our services. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of changes.

Eligibility & Account Registration

Section 2

You must be at least 18 years old or the age of majority in your jurisdiction
You must be a resident of India
You must provide accurate, current, and complete information during registration
You are responsible for maintaining confidentiality of your account credentials
You agree to notify us immediately of unauthorized access
One account per individual; business accounts require proper KYC verification

Permitted Use

Section 3

Facilitating digital payments for fuel and energy transactions
Managing Discount Cards and Corporate Cards
Accessing real-time transaction reports and analytics
Communicating with our support team

Prohibited Activities

Section 4

Use the Platform for illegal activities or money laundering
Attempt unauthorized access or hacking
Disrupt, damage, or impair Platform functionality
Use automated tools or scrapers
Engage in fraud, misrepresentation, or deception
Violate any applicable laws or regulations
Share credentials or allow unauthorized account access
Reverse engineer, decompile, or disassemble our systems

Payment Services & Fees

Section 5

Service Fees

  • Subscription Plans: Monthly subscription fees as per your selected plan
  • Transaction Fees: Processing fees deducted from each transaction
  • Hardware Costs: One-time costs for POS terminals, cards, and equipment (separate from subscription)
  • Setup Fees: Initial onboarding and configuration charges
  • Overage Charges: Additional fees for transactions exceeding plan limits

Billing & Payment

  • Subscriptions are billed monthly on your renewal date
  • Payments are processed automatically from your registered payment method
  • Failed payments may result in account suspension
  • All fees are in Indian Rupees (INR)
  • GST will be added to all charges as applicable

Refunds & Cancellation

  • Subscription plans can be cancelled anytime with 7 days written notice
  • Refunds will be processed within 7-10 business days of cancellation
  • No refunds for partial months or processed transactions
  • Dispute claims must be filed within 30 days of transaction

Fund Transfer & Settlement

Section 6

Transaction funds will be settled to your registered bank account as per agreed settlement cycles
Settlement timelines: T+1 (next business day) for most transactions
We are not liable for delays caused by banks or payment gateways
Chargebacks and reversals will be deducted from settlement amounts

Intellectual Property Rights

Section 7

All Platform content, including designs, logos, and code, is our exclusive property
You may not reproduce, distribute, or modify any Platform content
Your license to use the Platform is non-exclusive and non-transferable
You retain ownership of your data but grant us permission to process and analyze it

Limitation of Liability

Section 8

We are not liable for indirect, incidental, or consequential damages
Our total liability shall not exceed the fees paid in the last 12 months
We are not liable for third-party systems, payment gateways, or network failures
We are not liable for data loss due to your failure to maintain backups

Reserve Bank of India (RBI) guidelines and regulations
Prevention of Money Laundering Act (PMLA), 2002
Know Your Customer (KYC) norms
Goods and Services Tax (GST) laws
Data protection and privacy laws

Suspension & Termination

Section 10

Violate any provision of these Terms
Engage in fraudulent or illegal activity
Fail to pay subscription fees for 30+ days
Breach RBI regulations or compliance requirements
Provide false information during KYC

Dispute Resolution

Grievance Procedure

  • File complaints via email: support@smartfuelpay.com
  • Response within 7 days of receipt
  • Escalation to management team if unresolved
  • Final decision within 30 days

Arbitration

Any disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996. Single arbitrator, seated in Chennai, Tamil Nadu, India. Governing law: Indian law.

We implement industry-standard encryption (AES-256, TLS 1.2+)
We comply with PCI-DSS standards for payment data
Regular security audits and penetration testing
Data is backed up and stored securely
You are responsible for protecting your access credentials
